Terms of Use

As of: May 2026

This is an English courtesy translation. In case of any discrepancy, the German version prevails and is legally binding.

1. Scope

These Terms of Use apply to the use of the JACVault platform (the “Service”), operated by Alexander Vitanyi (the “Provider”). By registering for and using the Service, the user accepts these Terms.

2. Description of the service

JACVault is a web-based SaaS platform for the AI-assisted creation, optimization and management of application documents, in particular CVs and cover letters. The Provider makes the Service available within the scope of the selected subscription tier.

3. Minimum age and registration

Use of the Service is permitted only to persons aged 16 and over. By registering, the user confirms that they have reached the minimum age. Minors under the age of 18 require the consent of a legal guardian.

The user is obliged to provide truthful information when registering and to keep it up to date. Access credentials must be kept confidential and must not be passed on to third parties. The user is liable for all activities that take place under their account.

4. Subscription and payment

The Service is offered in various pricing tiers. Paid subscriptions renew automatically unless terminated in due time. Billing takes place in advance for the respective billing period. Payments are handled via the payment service provider Stripe. Price changes are communicated to the user at least 30 days in advance.

5. Right of withdrawal and waiver of withdrawal

Consumers are generally entitled to a statutory 14-day right of withdrawal (§ 312g BGB). As JACVault is a digital service that is immediately accessible upon conclusion of the contract, the right of withdrawal expires early pursuant to § 356(5) BGB where the user:

  • has expressly agreed that the Provider begins performance of the contract before the end of the withdrawal period, and
  • has confirmed that they lose their right of withdrawal upon commencement of performance.

By placing a paid order and activating the subscription, the user expressly declares their consent to the immediate commencement of performance and acknowledges that they thereby lose their right of withdrawal once the Provider has begun performance.

The complete withdrawal instructions and the model withdrawal form can be found at jacvault.de/widerruf.

6. Termination

The user may terminate their subscription at any time with effect from the end of the current billing period. After termination of the subscription, access to paid features is deactivated; the user account and all stored data are retained and can continue to be used within the scope of a free tier.

The Provider reserves the right to suspend or delete accounts without prior notice in the event of serious breaches of these Terms of Use. After final deletion of the user account (account closure), all user data is irrevocably deleted in accordance with the provisions of the privacy policy.

7. User obligations

The user undertakes:

  • not to use the Service for unlawful purposes
  • not to submit false or misleading content
  • not to upload content to which they hold no rights
  • not to misuse the Service (e.g. through automated bulk requests)
  • to respect the rights of third parties

8. Rights of use, intellectual property and prohibition of resale

The Provider grants the user a non-exclusive, non-transferable right to use the Service within the scope of these Terms. All content that the user enters into the Service (CVs, documents, etc.) remains the property of the user. The user grants the Provider the right to process this content solely for the purpose of providing the Service.

The user is not entitled to resell, rent, lend, transfer or sublicense access to the Service in whole or in part to third parties. Any use of the Service by third parties via the user’s account is prohibited.

9. AI-generated content and personal responsibility

JACVault is a digital aid to support the creation of application documents. The Service replaces neither individual career advice nor does it guarantee the success of application processes or the placement in employment.

All content created or optimized by the Service — including AI-generated text — is to be understood as suggestions and working aids. The user is solely responsible for:

  • checking the generated content for accuracy, completeness and personal suitability
  • ensuring that all information in the application documents is truthful
  • reviewing and approving the created documents before sending them to third parties
  • bearing the consequences of using the created documents

The Provider assumes no liability whatsoever for factual errors, incompleteness or inaccuracies in AI-generated content or for any resulting damages.

Pursuant to Regulation (EU) 2024/1689 (EU AI Act), which has been fully applicable since August 2025, the user is expressly informed that all text and suggestions generated in the Service are AI-generated content. JACVault is classified as a limited-risk AI system. The transparency obligation pursuant to Art. 50 EU AI Act is fulfilled by this notice.

10. No promise of application success

The Provider expressly gives no assurance, guarantee or warranty regarding the success of application processes, the suitability of application documents for specific positions or the reaction of employers to documents created with JACVault. Any prospects of success depend on numerous individual factors that are beyond the Provider’s control.

Use of the Service does not establish a contractual relationship in the sense of a success-based liability. The user uses the Service at their own responsibility.

11. Availability

The Provider strives for the highest possible availability of the Service but gives no guarantee of uninterrupted availability. Maintenance work is carried out, where possible, outside of peak usage times and announced in advance.

12. Limitation of liability

The Provider is liable without limitation only for intent and gross negligence as well as for damage arising from injury to life, body or health. Otherwise, the Provider’s liability — on whatever legal grounds — is limited to the foreseeable damage typical of the type of contract.

Any liability is expressly excluded for:

  • failed application success or job placements
  • factual errors or incompleteness in AI-generated text
  • damages arising from the unchecked use of AI outputs
  • indirect damage, lost profit or consequential damage

13. Changes to the Terms of Use

The Provider reserves the right to amend these Terms of Use with a notice period of at least 30 days. Changes are communicated to the user by email and/or by a notice on the platform. If the user does not object to the amended Terms within 30 days of notification, the amended Terms are deemed accepted.

14. Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies. In the case of consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

The exclusive place of jurisdiction for all disputes arising from this contract is Berlin, provided that the user is a merchant, a legal entity under public law or a special fund under public law.

15. Severability clause

Should any provision of these Terms of Use be or become invalid or unenforceable in whole or in part, this does not affect the validity of the remaining provisions. The invalid provision is replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
